26/11 trial: Court yet to issue warrants against 35 accused

    Nearly a month after the prosecution in 26/11 terror attack case urged for non-bailable warrants (NBW) against 35 absconding accused, including Jamaat-ud-Dawa chief Hafeez Saeed, a special court in Mumbai is yet to issue the same as the addresses of the accused have not been provided by the police.

    The NBWs have not been issued so far because of incomplete names and addresses of the accused, sources said.

    Confirming this, Special Public Prosecutor Ujjwal Nikam said, "Yes, we had sought for NBWs against the 35 absconding accused in the case but the court has asked for the complete addresses of these persons. We shall soon provide the same."

    While seeking the warrants, the police had given incomplete names and addresses of the accused, however, warrants cannot be issued on those addresses, sources said.

    For instance, warrants have been asked for absconding accused such as Major General Sahab, Kharak Singh, Usmaan, Aakib, Yusuf and Mursheed.

    Under provisions of the Criminal Procedure Code (CrPC), after non-bailable warrants are issued by the court, the police has to execute them by going to the houses of the absconding accused and arresting them.

    In this case, however, most of the accused are believed to be in Pakistan and thus the Government of India will have to approach Pakistani authorities for the execution of the warrants.

    If the absconding accused are not traced to the addresses mentioned in the warrants then they will be declared as proclaimed offenders.

    The 35 absconding accused against whom warrants have been sought are- Hafeez Muhammad Saeed alias Hafiz Saab, Zaki-Ur-Rehman Lakhvi, Abu Hamza, Abu Al Kama alias Amjid, Abu Kaahfa, Mujjamil alias Yusuf, Zarar Shah, Abu Fahad Ullah, Abu Abdul Rehman, Abu Anas, Abu Bashir, Abu Imran, Abu Mufti Saeed, Hakim Saab, Yusuf, Mursheed, Aakib, Abu Umar Saeed, Usman, Major General Sahab, Kharak Singh, Mohammed Ishfak, Javid Iqbal, Sajid Iftikhar, Col. R. Saadat Ullah, Khurram Shahdad, Abu Abdurrehman, Abu Mavia, Abu Anis, Abu Bashir, Abu Hanjla Pathan, Abu Saria, Abu Saif ur- Rehman, Abu Imran and Hakim Saheb.
