2G case: Former ROC says Swan Telecom was R-ADAG associate

A prosecution witness in the 2G spectrum case, who was the Registrar of Companies (ROC) in Mumbai from 2009 to January 2012, has told the special 2G court that on the basis of documents supplied to him by the CBI, he had submitted a report in March 2011 concluding that Swan Telecom was an associate of Reliance Telecom Ltd.

In his statement before Special Judge OP Saini on Friday, former Mumbai ROC Henry Richard said that he had examined various documents relating to Swan Telecom (P) Limited, Tiger Traders (P) Limited, Reliance Telecom Limited, Vikata Engineering Services (P) Limited and Giraffe Consultancy Services (P) Limited which were made available to him "subsequent to letter received from CBI to the Ministry of Corporate Affairs, wherein CBI had requested me to examine certain documents seized by them." He stated that "I examined all the abovementioned documents to come to a conclusion that Swan Telecom (P) Limited, which had applied for UAS licence, was an associate company of Reliance Telecom Limited/ Reliance Communication Limited and an ADA Group Company."

During his cross examination by advocate Vijay Aggarwal on behalf of accused Shahid Usman Balwa, Richard also admitted that he had not referred to all documents that were made available to him in the report. "A large number of documents were made available to me for examination, but for preparation of my report I picked up documents attached with my report and examined them only. I have not specified all the documents in my report which were made available to me," said Richards.

Richard's cross examination on behalf of the accused will continue on Monday.
