The Supreme Court on Friday rejected Uttar Pradesh Chief Minister Mayawatis plea for permission to undertake maintenance and other works at the controversial Rs 2,600-crore Ambedkar Memorial Park in Lucknow.
A Bench of Justices H S Bedi and J M Panchal felt that there was no change of circumstances to grant such permission to the state, which was earlier restrained by the SC from carrying out any construction activities at the site.
UPs counsels, including Mayawatis aide S C Mishra, argued that since lakhs of people were expected to come to the park for the nirvana divas of B R Ambedkar on December 6,it was necessary to undertake certain works at the memorial.
Opposing the states plea,A M Singhvi, appearing for petitioners Mithilesh Kumar Singh and Gomti Nagar Sanstha said such arguments cannot be trusted as the state had earlier violated the undertaking given to the court that it would stop all construction works at the site.
The apex court, however, said it would examine the plea further when the main matter related to the larger issue of whether such constructions could be carried out at the expense of tax-payers money comes up for hearing on November 30.
