BSY challenges Hegde report in HC

Caretaker Chief Minister of Karnataka B S Yeddyurappa launched a dual attack on the Lokayukta report on illegal mining here on Tuesday by filing a petition in the Karnataka High Court seeking the quashing of the July 27 report with respect to his own indictment.

Yeddyurappa also dropped off a letter to the Lokayukta office — where new incumbent Justice Shivaraj Patil takes over on Wednesday — asking to be allowed to explain his defence against the indictment.

In his petition filed before the High Court,the main argument that the caretaker Chief Minister put forward is that “the report has been made without hearing the petitioner in violation of principles of natural justice”.

Yeddyurappa was forced to resign as the CM on July 31 by the BJP high command after outgoing Lokayukta Justice Santosh Hegde in chapter 22 of his report recommended his prosecution under the Prevention of Corruption Act,1988.

“The Lokayukta before giving his report did not call for the explanation either by the petitioner,or sons of the petitioner,Prerana Trust,or South West Mining Company Limited,or Jindal Group. As such,the findings arrived at by the Lokayukta are unsustainable,” Yeddyurappa said in his petition.

According to Yeddyurappa’s petition,the Lokayukta has also gone beyond the scope of the reference made to him by the government while seeking a report on illegal mining.
