Can’t allow more than 10 people at mosque site: HC

Refusing to soften its stand,the Delhi High Court on Friday dismissed a plea on allowing more than 10 people to offer namaz at the site of the demolished mosque that encroached on a piece of land belonging to the Delhi Development Authority in Jangpura.

Refusing to soften its stand,the Delhi High Court on Friday dismissed a plea on allowing more than 10 people to offer namaz at the site of the demolished mosque that encroached on a piece of land belonging to the Delhi Development Authority (DDA) in Jangpura.

Justice G S Sistani dismissed the application by Noor Charitable Society,which had been managing the mosque. “The land does not belong to you. I have ordered a status quo for a period of two months to facilitate the resolution of the issue. The prayer seeking a waiver on the number of ‘namazis’ cannot be allowed at this stage.”

After the Delhi Waqf Board and the society had said they were contemplating a legal recourse to reclaim the land,the court had on January 17,as an interim measure,allowed 10 people to offer prayers on the disputed site for the next two months.

The court had,however,clearly said the land did not belong to the Waqf Board or the society,and that they should follow a legal recourse instead of being witness to a “breach of law”. The court had also ordered the DDA to reclaim the land and construct a boundary wall around it under police protection.

A mob had reportedly demolished the wall and offered prayers in violation of the court order. The court had,on the last date of hearing,cautioned the leaders against creating any communal divide.

It had also asked the DDA to carve out a 2.5-feet gate to allow no more than 10 namazis to offer prayers till the next date of hearing,which has now been fixed in March.
