India and EU have worked out an interim settlement according to which none of its 27 members will detain Indian generic medicines transiting via Europe on mere suspicion of intellectual property right (IPR) violations.
They (EU) will issue interim guidelines to their customs advising them how to take our understanding into the EU legislation, said Rajiv Kher,additional secretary in the commerce ministry.
About 17 detentions took place in 2008 at Schiphol Airport in Amsterdam. The consignment of generic medicines were destined for Latin American countries.
