Eviction case: HC asks trial court to hear Sonal Mansingh

Classical dancer and Padma Vibhushan awardee Sonal Mansingh received respite from the Delhi High Court on Monday as it set aside a 2009 order directing her eviction from a rented accommodation in Defence Colony.

Classical dancer and Padma Vibhushan awardee Sonal Mansingh received respite from the Delhi High Court on Monday as it set aside a 2009 order directing her eviction from a rented accommodation in Defence Colony.

Accepting Mansingh’s contentions that she did not get due opportunities to defend the petition by her landlady,Justice P K Bhasin,has now asked both the parties to appear before the trial court on September 26 for adjudication of the dispute afresh.

Mansingh had challenged the order of an Additional Rent Controller,directing her eviction from the ground floor of a residential property in Defence Colony,which she has been occupying as a tenant since 1976.

The order was initially passed in September 2009 as her landlady Beena Omprakash sought her property back on the ground that she required the premises for her own use and also in the wake of her specific requirement because of her ailments as also of her 78-year-old husband.

As per Mansingh’s petition,she never received summons from the court,but got to know about it only after a bailiff showed up at her doorstep.
