The Gujarat High Court (HC) has reserved its order on the anticipatory bail applications of Yashpal Chudasama and Ajay Patel ,both accused in the Sohrabuddin Sheikh fake encounter case. The two were granted anticipatory bail on September 21 for 90 days,which ended on Tuesday. They approached the HC either to extend the period or grant them fresh bail. Their counsels have argued that since they were granted anticipatory bail by the HC,they should be granted the bail this time too as there are no major changes in the circumstances. The Bench of Justice Anant Dave concluded hearing of the two applications on Tuesday. The Central of Bureau of Investigation (CBI) has opposed the bail pleas and have challenged its maintainability. The CBI counsel had argued that the probe agency has challenged the September 21 order in the Supreme Court and the appeal is pending. In such circumstances,the petitioners should have approached SC for anticipatory and so it cannot be maintainable at HC. Even otherwise,the CBI opposed the petitions stating that circumstances have changed a lot in the case and the custodial interrogation of both is required. After hearing the two parties,Justice Anant Dave reserved the order till Wednesday.
