Ending months of uncertainty over the state governments stand on the possible premature release of Rajiv Gandhi assassination convict Nalini Sriharan,the government on Monday informed the Madras High Court that the Prison Advisory Board constituted to decide on the request had rejected her plea,a decision which the state accepted.

There was serious speculation about the nature of the report prepared by the board with many claiming that it was positive for Nalini,who appealed that she be set free after over 19 years of continuous imprisonment since her arrest in early 90s.

However,clearing the air on Monday,State Advocate General P S Raman informed a Division Bench comprising Justices Elipe Dharma Rao and K K Sasidharan that the board had rejected her plea on eight counts and that the government had decided to accept the report. A Government Order had been issued in this regard on March 24.

Among the reasons cited by the board for its decision are gravity of the crime and her participation in it,her release will create law and order problems,and her petition that she is the mother of a child is not acceptable. As such,the case was not fit for release,said the board.

The Division Bench dismissed the petition filed by Janata Party president Subramanian Swamy challenging Nalinis eligibility to plead for remission,arguing that she had already received one when the death sentence initially awarded was reduced to life in prison. The court,however,reserved orders on the appeal from advocate Radhakrishnan questioning Nalinis

continued detention on technical grounds.
