AFT revises pension of Hony Lts and Hony Capts

In a landmark judgment, a bench of the Armed Forces Tribunal in Chandigarh has allowed 31 petitions filed by a number of Hony Lts and Hony Capts, and directed the government to revise and fix their pensions.

The bench held the Hony commissioned officers of the rank of Hony Lt entitled to fixation of basic pension at the rate of Rs 15,465 per month — earlier he used to get Rs 13,500. The Hony Capt will now get a pension of Rs 16,145 per month — the previous figure was Rs 13,850.

Judicial Member Justice Ghanshyam Prasad and Administrative Member Lt Gen N S Brar (retd) also ordered that the petitioners be paid arrears from July 1, 2009 onwards within four months. "Out of a total 31 petitions decided by the bench, 19 were filed by the All India Ex-servicemen Welfare Association (AIEWA) on behalf of 380 Hony commissioned officers, who were discharged before January 1, 2006. Their pension was calculated wrongly, which resulted in lower amounts," said AIEWA Chairman Bhim Sen Sehgal.

The Association had taken up the case in a representative capacity with the government. However, the demands of the Hony Officers were not accepted, as a result of which such petitions were filed in the Chandigarh AFT.
