Angry HC fines Gutkha firm for wanting to hire ‘retired judges with contacts’

  • Today, over a year after the advertisement made its appearance, DS Group appeared before the Delhi High Court, not to argue their brief but to “profusely apologise” for the advertisement which, according to Tiwari, gave the picture that “the advertisers are confident and believe that having contacts in the judiciary would fetch them favourable orders or relief”.

    The DS Group counsel, Deepak Dhingra, told a division bench of Justice Mukul Mudgal and Justice Manmohan that he was ready to accept whatever penalty the court decided on.

    Justice Mudgal, however, relented a little because “you (DS Group) have shown your willingness to accept a mistake.” But the DS Group was fined Rs 1 lakh. The money will be used to eradicate child labour in the Capital.

    The bench congratulated Tiwari “for bringing the advertisement to their notice... we will surely mention the good work you did in our orders.”

    Dumb DecisionBy: Sumant | 24-Oct-2008 Reply | Forward What's wrong with hiring retired judges? Industry contacts are common in recruitment, and as long as they don't influence decisions, it's not against the law. This fine is ludicrous.
    Good response from JudiciaryBy: KVSKumar, Mumbai | 23-Oct-2008 Reply | Forward Kudos Delhi High Court for this act. But I must confess that this fine is nothing but peanut for the Gutka barron. The HC should have fined them with a few crores. The money in any case would come handy for computerization and improving the working conditions of our judiciary which will ultimately benefit the comman man in the form of speady trial and deliverance. I request the judges to keep this in mind when confronting such blatent irresponsibility by those with money and muscle power.
