Following a plea by the government on Monday in Supreme Court that Delhi has no sanitary landfill sites,the Delhi High Court will now look into the feasibility of alloting land at Bhatti Mines in South Delhi for the disposal of solid municipal wastes after the apex court order suggested a re-look at a ban against dumping of municipal wastes in the area.
A three-judge Bench led by Chief Justice of India SH Kapadia asked the Delhi High Court on Monday to expedite a decision on the question of solid waste disposal even as the city is gearing up for the Commonwealth Games to be held in October. The Supreme Court sought the High Court to expeditiously hear and dispose of the matter,preferably within the next three months.
The order came after the Additional Solicitor General (ASG) Parag Tripathi appeared for the Municipal Corporation of Delhi (MCD) and submitted that the national capital does not have a suitable dumping site.
He (ASG Tripathi) wants permission for dumping waste at Bhatti Mines,to use it as a solid landfill site. The MCD and the Delhi government has sought the intervention of the Development Commissioner,NCT,Delhi,to consider the allotment of land at Bhatti mines in favour of the NCR for purpose of disposal of solid wastes, the court observed.
It could be ideal,looking at the local conditions,if matters are examined by the Delhi High Court. The matter shall stand referred to the Delhi High Court for further orders, it ordered.
The Bench,meanwhile,retained other connected petitions raising national concerns on the subject of solid waste management and the viability of the projects for generation of energy from municipal wastes.
The court was hearing applications filed by the government and the MCD in 2005. NGO Forum for NCR had opposed the applications.
