Bombay High Court (HC) asked a Congress member, who has filed a PIL seeking action against American film 'Innocence of Muslims', to approach Mumbai Police Cyber Cell for inclusion of additional sections in the FIR. The film evoked sharp reactions, including violent protests, across the world after it was released on the internet.
Ejaz Naqvi, lawyer for the petitioner, told HC the FIR had been filed only under IPC section 295A and demanded that other sections, such as those pertaining to provocation with intent to cause riot, and sections of Information Technology Act, 2000, pertaining to publishing of obscene content in the electronic form, be also applied.
In response, a division bench of Justices A M Khanwilkar and R Y Ganoo asked the state government to explain why these sections were not invoked and posted the case for hearing on November 21.
