The vacation bench of the Bombay High Court has adjourned the hearing of an anticipatory bail plea filed by Shiv Sena activists till January 4.
Around 22 Shiv Sena workers from Nashik have moved the court seeking anticipatory bail following a complaint filed by a Maharashtra Navnirman Sena (MNS) activist alleging assault by Shiv Sena workers. According to his complaint,a day after the recent Assembly election,around 42 Sena workers barged into his house,assaulted him and snatched his chain and ring. He also stated that the accused snatched necklaces from his mother and brothers wife too,and shouted slogans like Jai Bhavani,Jai Shivaji.
As many as 10 accused have already been granted anticipatory bail by the additional sessions judge in Nashik. Also,around 12 MNS workers have been granted anticipatory bail following a counter complaint filed by the Sena workers.
Following the incident on October 14,four of the Sena workers were booked under section 395 of the Indian Penal Code (IPC) for dacoity while 22 workers were booked for rioting and unlawful assembly.
The lawyer appearing for Shiv Sena activists told the court that a case of dacoity cannot be slapped on them and produced a Supreme Court judgment to support his claim.
