Bagwe files defamation suit against Sena leaders

Congress MLA Ramesh Bagwe on Thursday filed a defamation and criminal conspiracy complaint against Shiv Sena leader Sadanand Krishna Shetty and Arun Nigvekar,associate editor of Sena mouthpiece Saamna,for allegedly publishing false and defamatory news concerning him.

Bagwe filed the complaint through his counsel P Narayan and others before the court of Judicial Magistrate First Class (JMFC) V D Deshmukh. It stated that the newspaper had published reports on May 13,15 and 26,2010,alleging that there are 19 offences registered against Bagwe u/s 498 A (cruelty against married woman by relatives),363 (kidnapping),342 (wrongful confinement),143 (unlawful assembly),323 (voluntarily causing hurt),504 (intentional insult)and 506 (criminal intimidation) of the Indian Penal Code (IPC). The news report also alleged that Bagwe was finding it difficult to renew his passport after a negative verification report from Pune city police,due to these alleged cases.

But Bagwe,who is former minister of state (home),found that only three cases were pending against him in the court and all of those were of political nature. “While the case under 498(A) registered at Kotwali police station in Ahmadnagar city is pending in a sessions court,Bagwe is not mentioned as an accused in it,” the defamation suit said.

Saying there was no truth in the news reports and it was published deliberately to malign the reputation of Bagwe,he has moved the petition against Shetty and Nigvekar under sections 499 (defamation),500 (punishment for defamation) and 120 B (criminal conspiracy) read with 34 (common intention) of the IPC. As per the complaint,“Shetty,along with Nigvekar published the news with intention to defame and lower down the image of Bagwe in eyes of people at large.” The complaint further reads that the said act was committed with wrong intentions.

Bagwe had won the September – October 2009 assembly elections from Pune cantonment constituency by defeating Shetty,who had got the second highest votes.
