Terming the rules framed by the Bar Council of India as draconian whereby an all-India examination will be held for law students to join the legal profession,Bar Council of Punjab and Haryana Chairman Partap Singh today resigned from his post.
Strongly protesting the decision of the Bar Council,Partap has rubbished the decision of the Bar Council of India and has called for a special meeting of chairmen of all the Bar Councils on July 10. Partap has taken a dig at the Bar Council of India for not keeping a check on the illegal law institutes in the country. In a press statement,Partap has submitted that the Bar Council of India should lay stress on regular appraisal of legal education in law institutions rather than introducing such rules. Till the time a new chairman is selected,Partap will function as the chairman for the Bar Council of Punjab and Haryana.
It might be recalled that four students of law at Panjab University have already challenged the decision of Bar Council of India and also made the Bar Council of Punjab and Haryana along with Union of India opposite parties in the petition.
The petitioners after having completed their graduation and qualifying their entrance test were admitted to LL.B (3 years/5 years course) in the Department of Laws,Panjab University,Chandigarh,in July 2007-08. The petitioners appeared in the final semester examination in April 2010 and are awaiting for the declaration of their result.
The petitioners were astonished on receiving information through the internet on the website of The Bar Council of India wherein it was highlighted that No advocate enrolled under Section 24 of the Advocates Act,1961 shall be entitled to practice under Chapter IV of the Advocates Act,1961,unless such advocate successfully passes the All India Bar Examination conducted by the Bar Council of India.
It is clarified that the Bar Examination shall be mandatory for all law students graduating from academic year 2009-2010 and onwards and enrolled as advocates under Section 24 of the Advocates Act,1961, reads the petition filed though senior advocate Sanjay Bansal. The petition is slated for hearing on June 30.
