The Bombay High Court on Wednesday refused to grant bail to Himanshu Jaiswal alias Dolly,who is accused of practising black magic on her niece and nephew resulting in their deaths. Dolly sought bail on the grounds that she was a young woman and falsely implicated in the case.
However,the court refused to grant bail after taking into account the seriousness of the allegations against her and directed the trial court to complete the trial in three months.
Dolly and six other members of her family were arrested by the Nalasopara police after two children Om (5) and Ritika (2) died when Dolly allegedly tried black magic on them to exorcise evil spirits.
According to the prosecution,on October 15,2010,Dolly claimed she was possessed by God. She said the spirit of another aunt of the children,who was recuperating in a hospital,was evil and had entered the body of the children.
Following her instructions,the family members held the children,while Dolly danced on their bodies and later strangulated them,the prosecution said.
Dinesh and Rita Jaiswal,also accused in the case,were granted bail by the same court on Tuesday. Dollys Lawyer Nilesh Pawaskar sought bail on the grounds of parity. Dinesh and Ritas lawyer RV Gupta had argued that although they are facing trial with the other members of the family,they cannot be booked for murder.
However,Justice AM Thipsay said not all accused in the case had been granted bail.
