BSF authorities order revision trial in Felani murder case
The accused BSF constable was identified as Amiya Ghosh of 181 Battalion of the BSF.
Ahead of the visit by DG (BSF) Subhas Joshi to Bangladesh to attend the high-level meeting between border security forces of both countries,the competent authority of BSF Saturday decided to hold a revision trial in Felani Khatuns death case.
Felani Khatun,a Bangladeshi national,was killed on the Indo-Bangla border near the Choudhuryhat border outpost in Cooch Behar after a BSF constable opened fire at her in January 2011.
The accused BSF constable was identified as Amiya Ghosh of 181 Battalion of the BSF. Ghosh was charged with culpable homicide and chargesheeted. The force initiated a General Security Force Court (GSFC) trial against him after the photograph of Felanis body hanging from the barbed wire fencing evoked international outrage.
The trial court found the accused Ct Amiya Ghosh not guilty and pronounced findings on September 6,2013. A BSF spokesperson from Delhi said,As per BSF Act and Rules,proceedings were reviewed by legal experts. The competent authority has not agreed with the findings of the court and has decided to hold a revision trial. The authority aims at bringing justice to the victim family.
B D Sharma,ADG,BSF (East),said,Having gone through the trial proceedings and available evidence on record,I have refused to confirm the findings of the court and returned the case for revision. The court will re-evaluate the evidences and the additional witnesses. If the court feels,it might call the witnesses from Bangladesh again. After the revision,the report will be submitted to me again and I will take another view of the findings.
Father of the victim,Nurul Islam,said no warning was given before opening fire at his daughter. According to rules,warning is mandatory before firing.
Abraham Lincoln,Nurul Islams lawyer,said,We are relieved with the announcement. We wanted the judgment to be
reconsidered.
