The government is sitting over Comptroller and Auditor General of India (CAG) Vinod Rais request for returning his ACR dossier for the past over one year. As per the rules of the Department of Personnel and Training (DoPT) governing the service and retirement of IAS officers,retired IAS officers are eligible to get back their ACR dossiers two years after the date of retirement.
In a surprise move,a committee headed by the Cabinet Secretary has even sought the opinion of the Ministry of Law and Justice on whether Rai is entitled to get back his ACR dossier or not.
Rai,a 1972 batch Indian Administrative Service officer of the Kerala cadre,was posted as Secretary,Department of Financial Services in the Ministry of Finance,when he was appointed CAG. While he was to retire on May 31,2008,he joined as CAG on January 7,2008.
On June 29 last year,after waiting for the mandatory two years,he wrote to the DoPT,seeking handing over of his ACR dossiers.
Sources in the DoPT told The Indian Express that while it had been decided initially to hand over the dossiers,the matter was put on hold after one of the officials questioned if Rai,since he was still working in the Government of India as CAG,could be deemed to have superannuated.
The Civil Services Board,which is headed by the Cabinet Secretary,also felt the need to look into the issue more carefully and,therefore,has sought the opinion of the Law Ministry.
Sources said another issue that the DoPT wants settled once and for all is whether civil servants,who,though retired,are still working with the government in positions such as Central Vigilance Commissioner and Central Information Commissioner,are entitled to get their ACR dossiers.
