Cancel affiliation if colleges flout admission norms: HC tells university

To prevent admission of ineligible students,the Bombay High Court has directed the Mumbai University to issue circular to affiliated colleges in the state saying that their affiliation will be withdrawn if admitted students fail to fulfil the criteria.

A Division Bench of Justice P B Majmudar and Justice M R Bhatkar has directed the university to publish this notice/circular in all the leading dailies in order to make the colleges and persons concerned aware of the directive and to deter them from admitting ineligible students. University counsel Rui Rodriguez said,“The court has not given any time frame for issuing the circular and subsequent advertisements but it would be done before the next academic year.”

The High Court was hearing a petition filed by a second year Bachelor of Science (Information Technology) student,Swanand Agarkar,who is studying in Uran Education Society. According to his petition,on June 8,2009,he was granted admission on a percentage of 43.67. On September 17 this year the authorities informed him that he has been disqualified since he did not fulfil the admission criteria.

In a major relief to Agarkar,the court directed the college to admit him again even though he was not eligible. The court said,“This should not be taken as a precedent and should be treated as an exception.” According to the university rules,the cut-off percentage for the course for which Agarkar had applied is 45 in the open category and 40 per cent in the reserved category.

Earlier,the Bench had said,“How was he given the admission? Who is the trustee of the college?” After being informed that the trustee was a builder,the Bench had said,“Criminal prosecution should be initiated against him on charges of cheating.”

The trustee who was also present in the court tendered unconditional apology and informed the court that the college has been running since 1978 and it was the first such incident and would never be repeated.
