The Central Bureau of Investigation (CBI) has given a clean chit to four policemen who were accused of raping a girl and molesting her younger sister in the presence of their parents at Kubersthan police station in Kushi Nagar in 2010. The then pradhan of Badgaon village,Ramayan Prasad,was also an accused.

The CBI,which investigated the case on the direction of the Allahabad High Court,found the charges against the policemen and the pradhan baseless and filed a closure report in a local court of Lucknow recently. The report has not been accepted by the court,and a protest application has been filed.

In June 2010,Nagina Devi of Badgaon village moved the Allahabad High Court,seeking stay on her arrest and quashing of an FIR filed against her and others in a case of physical assault lodged at Kuber Sthan police station in May 2010.

She alleged that the police lodged the FIR only to counter two cases she had filed against policemen and others. In one,Nagina Devi had accused four policemen and the gram pradhan of raping and molesting her two daughters. In the second,she accused local youth Suresh Chauhan and 14 others for threatening,beating and compelling her to compromise in a rape case with the police.

The court directed the CBI to investigate all three cases. The agency found there had been no rape and molestation,but other allegations of beating up made by Nagina Devi and villager Ram Asrey against each other were true. In fact,the lodging of the rape case had led to violence. The CBI has filed chargesheet in the two cases of assault.

A CBI official said they sent the girls and their clothes for medical examination,but no evidence of rape was found. Also,the alleged rape victim and her family refused to undergo a polygraph test. The policemen underwent a polygraph test but came out clean.

The four policemen — then Station Officer Mohan Ram,constables Munna Upadhyay,Vimal Kumar Pandey and Jai Prakash Singh — who were placed under suspension have since been reinstated.

Ramayan Prasad said the woman and her family had grabbed a dry pond in the village and even undertaken some construction there. On April 19,2010,the police arrested Nagina Devi,her husband Aadya Singh and her two daughters for allegedly misbehaving with a team of officials which had gone to make measurement of the pond after getting a complaint. They were booked for breach of peace,and freed on bail after three days.

After coming out from jail,Nagina Devi lodged the FIR,saying the policemen had raped and molested her daughters in the police station and they,along with the pradhan,had also threatened them.

“Nagina Devi framed me and the policemen only to create pressure to prevent further action against her,” he said.
