CBI sought govt nod to prosecute CID officer for escape of Tamang’s ‘killer’

The Central Bureau of Investigation (CBI), which is probing the murder of Gorkha leader Madan Tamang, had sought state government's nod to prosecute former Investigating Officer of the CID, A S Pahari, for the escape of Nicole Tamang, the prime accused in the case.

According to the CID, Nicole had escaped from Pahari's custody on the morning of August 22, 2010 when they had taken him to the CID camp office at Pintail village near Siliguri .

Two months ago, a senior CBI officer met state Law Minister Moloy Ghatak on two days — June 27 and 28 — and sought the government's nod to prosecute Pahari under Section 197 of the CrPc for Nicole's escape. The central probe agency is yet to receive the nod from the state government.

"The officers of the Law Department may have received it (the file from the CBI) and they are dealing with the case," said Ghatak.

The CBI, which had taken over the murder probe on December 20, 2010, had filed a status report on the "disappearance" of Nicole to the Calcutta High Court after a petition was filed by Nicole's wife, Pema Tamang, who had accused the CID of abducting her husband.

In its status report, filed by the CBI on February 17, 2011, a CID team led by Pahari had interrogated Nicole the entire day on August 21, 2010 and during that entire period, he was not handcuffed. After the medical examination of Nicole at Siliguri hospital, Pahari released the escort party at the CID camp office and the team interrogated Nicole up to 10.30 pm. At that time, three sub-inspectors — Sandip Ganguly, Anupam Chakraborty, Anirudha Chatterjee, two constables — Aribinda Kumbhakar, Ajay Rai — and Pahari were present.
