The Central Government has moved the Bombay High Court, challenging the decision of the special court to summon National Security Guards (NSG) commandos to depose in the 26/11 terror attacks trial against captured terrorist Ajmal Amir Kasab.

Additional Solicitor General Darius Khambatta mentioned the petition on Tuesday on behalf of the Central Government. The Division Bench of Justice JN Patel and Justice Amjad Sayed has kept the petition for hearing on Wednesday.

Judge ML Tahiliyani — special judge presiding over the 26/11 trial — had summoned three NSG commandos who were part of the team that stormed the Taj Mahal Palace, Hotel Oberoi Trident and Nariman House during the terror strikes. The special court had summoned three commandos — Lt Col Rakesh Kumar Sharma, Major Ravindra Prakash and Captain Anil Jakhad — to testify regarding the operations carried out by them.

The judge had issued fresh summons on October 27, asking them to appear on November 9. Special public prosecutor Ujjwal Nikam had told the court that he had received a report from the elite commando group, saying Lt Col Sharma was suffering from gastroenteritis and admitted to a hospital at Manesar in Haryana. The trial court had issued fresh summons to him also.
