With premium flats at the Commonwealth Games Village still mired in controversy,the Delhi High Court has asked the Ministry of Urban Development (MoUD) to take a final call on grant of completion certificates for these apartments so that buyers get possession of properties.
Justice Rajiv Sahai Endlaw,hearing petitions filed by buyers seeking a directive to secure control of their properties,has given the MoUD one month to communicate its stand on the issue.
Let MoUD file a response in a months time on whether completion certificates can be issued (for) the flats at the Commonwealth Games Village, Justice Endlaw said. The matter will come for hearing in November.
The court,meanwhile,refrained from discussing the Delhi Development Authoritys argument on auctioning of 100 flats to ascertain their rates.
The DDAs plan was opposed by advocate Rahul Dhawan who was appearing for a group of flat-owners. He questioned how the DDA could auction the flats when they did not have the completion certificate.
Meanwhile,a group of allottees recently met Urban Development Minister Kamal Nath and submitted a representation to him.
In our representation,we questioned why we should suffer because of a dispute between the DDA and Emaar MGF. We have already bought the flats. This is not only troubling us,but also leads to a huge loss as the DDA has not been able to auction its own flats. Moreover,the Games Village flats are in a state of neglect with no proper maintenance taking place, said Rohit Gulati,who has been allotted a flat.
The Lt Governors office,it is learnt,has asked the DDA to prepare a note on regularisation of excess construction beyond compoundable limit at the Games Village. It had also raised questions on the reason for excess construction and the monitoring mechanisms.
The Delhi Urban Art Commission,which is supposed to hand out completion certificates,had earlier rejected the DDAs proposal to hand out a conditional completion certificate for the Village flats,asking the land owning agency to first sort out the matter concerning the excess Floor Area Ratio (FAR). The MoUD also has to take a final decision on the excess FAR.
