CID will take up cases if not solved by cops in 30 days: HC

The Gujarat High Court has ruled that all the complaints of missing persons will be automatically transferred to the CID (Crime) if the concerned local police fail to solve the case within 30 days.

In a recent ruling, the court also ordered to set up a special Women's Cell in the CID.

A division bench of Justices M R Shah and S H Vora passed a judgment while acting on a habeas corpus petition of one Bharwad Gagubhai of the Panchmahals district.

According to Bharwad's lawyer Aftabhusen Ansari, Bharwad's 21-year-old daughter was allegedly abducted by a man from Madhya Pradesh who was living in Panchmahals in September 2011. Bharwad lodged a complaint with the local police in this regard. When no breakthrough was made, Bharwad moved a habeas corpus petition before the HC.

Ansari said the court took the issue very seriously and even invited suggestions from lawyers on methods to be adopted in such cases of missing or abducted persons in general and girls in particular.

"In the judgment, the court has ordered that any missing or abduction complaint of girls or boys will be investigated by the local police for 30 days. And if the local police do not crack the case, the complaint will automatically be shifted to CID (Crime). The court has also ordered to establish a special cell for missing women at CID (Crime) in this regard," said Ansari.

He added the court has also ordered that in the case of abduction or missing persons below the age of 14, a high-profile investigation would be conducted by the CID (Crime).
