Consumer forum issues warrant against pest control owner

The Consumer Disputes Redressal Forum has issued non-bailable warrants against the proprietor of Pest Free Control Services for non-compliance of its orders.

The Consumer Disputes Redressal Forum has issued non-bailable warrants against the proprietor of Pest Free Control Services for non-compliance of its orders. In a complaint given to the forum,Sector 40 resident Dev Prakash Kapur had stated that on May 21,2009,he had hired the pest control service for his newly constructed house at Shivalik Enclave,Mohali. A guarantee of three years was given.

The complainant said that he had been told that if problems arose within that period,the affected area would be treated free. After three-four months,termites damaged the chowkhats of the rooms,cupboard and kitchen which caused damage to the tune of Rs 50,000.

The complaint said that a number of requests were given to the agency for treatment of the damaged portion and a notice was also served but to no avail. So a complaint was filed.

In its orders on August 19 last year,the Forum directed that the complainant be paid Rs 10,000 as compensation along with Rs 1,100 as cost of litigation. The orders were not complied with.

Thereafter an execution application was filed by the complainant to punish the proprietor,Ritika Ahluwalia,for not complying with the order. Ahluwalia,however,did not make an appearance.

The Forum observed that the order has not been complied with despite sufficient opportunity being available and even after the lapse of about five months. It sentenced Ahluwalia to six months imprisonment and imposed a fine of Rs 5000.

In default of payment,she would further suffer imprisonment of three months. Non-bailable warrants have been issued for February 16,2011,for her arrest and detention in jail.
