Petition says Sanghani had made 'derogatory remarks' against judiciary.

The Gujarat High Court on Monday adjourned hearing on a petition that has sought contempt of court proceedings against state Law Minister Dileep Sanghani for allegedly making derogatory remarks against judiciary.

A division bench of justices D H Waghela and G R Udhwani adjourned the petition as in any criminal contempt of court proceedings, the consent of the Advocate General is needed. In this petition, it was told that the Advocate General was out of station. So, the petition has been kept for hearing on December 10. The petition has been moved by one Rajendra Mistry.

According to Mistry's lawyer Amee Yajnik, who is also a member of Gujarat Congress Legal Cell, the matter relates to a public speech delivered by Sanghani in July last year. "In the speech, he (Sanghani) made some derogatory remarks against judiciary while adding that courts are not above law. He used some contemptuous words against the judiciary," Yajnik said.

"We have moved the petition contending that Sanghani was making the statements as a law minister. If he was making such remarks, then common people will lose faith in judiciary," she added.

The issue was first raised by Gujarat Congress's legislative party leader Shaktisinh Gohil, who had sought Sanghani's resignation.
