Cops refuse to file rape case,mother moves HC

The mother of a 14-year-old girl,who was allegedly raped after being illegally detained by a neighbourhood boy,has moved the Bombay High Court urging it to direct the police to register an offence against him.

The petitioner is the wife of a life convict in the Santacruz bomb blast of 1998 that killed two persons. The petitioner,who works as a domestic help,said her daughter who studies in Class IX in a Bandra school was alone at home on May 3. When she returned,she found the girl missing. Her mother filed a missing person’s complaint at the Bandra police station a day later.

“I went to the police station repeatedly to ask about my daughter but they did not entertain me,” she said. On May 17,the girl’s mother learnt that the girl was staying at her sister-in-law’s house in Santacruz.

The relations between the girl’s mother and her sister-in-law were strained after the former deposed against her husband in the bomb blast case. The girl told her mother that she was taken to a dargah in Kalyan by one Irfan,who took her to a guesthouse and allegedly raped her. The girl said she was introduced to Irfan at a wedding in the locality by their neighbour Asma Shaikh,who took her to Kalyan and handed her over to Irfan.

“He gave me water and it had something that made me drowsy,” the girl said. Her mother said when she regained consciousness,she was naked and bleeding profusely. “My mouth was gagged and I was threatened not to tell anyone about the incident,” the girl said.

Their petition in the HC states that when the girl was found,they went to the police station,but the officers refused to register a complaint. “We were told that we should be glad that the girl is back and not pursue any complaint,” the girl’s mother claimed.
