Working in a bar is not a sin, the Bombay High Court observed on Tuesday and said the society needs to change its mindset towards women employed in bars.
If women can work in the armed forces and be away from home,why can they not work in bars after 9.30 pm? A woman can voluntarily go to a bar as a customer,or even open a liquor bar herself. Then why can she not be employed at such an establishment? Justice Ranjana Desai asked.
The court was hearing a petition filed by the Womanist Organisation of India and a number of other organisations against the 9.30 pm deadline imposed on women waitresses and singers under the Bombay Shops and Establishments Act (BSEA) of 1948. The court observed that the state governments policy infringes on the right of women to earn their livelihood.
Counsel for the state government Vasant Kotwal said that the government also had to ensure the safety of women working late at night. Justice Desai,however,said,If adequate security cannot be provided to women working late at night,it is the fault of the system and needs to be corrected. You (state government) cannot put restrictions on women merely on these grounds.
The court will continue hearing the case on Wednesday.
