Court rejects Amarinder plea for stay on expulsion

  • Former chief minister Capt Amarinder Singh today moved the Punjab and Haryana High Court, demanding quashing of the decision to unseat him from the Vidhan Sabha. However, the court turned down his plea for a stay.

    The voluminous petition, running into over 500 pages, will come up for hearing tomorrow before a division bench comprising Justice A K Goel and Justice Ajay Tewari.

    Amarinder has demanded that the resolution passed by the special house committee indicting him and two others in the Amritsar land case be quashed. Alleging that the law of natural justice has been violated by the Punjab government, he has alleged that he has again been made a victim of political vendetta. Amarinder has also alleged that he was not given a hearing.

    Expressing urgency, the counsels for Amarinder kept shuttling from one court to another, as two division benches recused themselves from the petition. Finally, at 3.30 pm, the petition was referred to another division bench by Chief Justice Tirath Singh Thakur.

    Arguing the petition and demanding a stay on the decision of the House, senior advocate Uday Lalit submitted that the House has no powers to order the registration of an FIR and custodial interrogation of Amarinder. “To find someone guilty is not the function of the House. It is the function of the adjudicating machinery of the government. It is the function of the courts. Likewise, to order the custodial interrogation of an individual is the function of the police. Even the Supreme Court has not appreciated the orders wherein the High Court had ordered the custodial interrogation of an accused. Passing such orders is beyond the jurisdiction of the House,” he said.

    The Court questioned the reason behind the urgency of the case. Making it clear that no notices or stay will be issued at this stage without hearing the parties, the Court deferred the case to Friday.
