Court rejects CBI closure report, orders further probe

A special court on Friday rejected the CBI's closure report in the case of the mysterious death of Dr Y S Sachan, former deputy CMO of Lucknow, in a local jail on June 22, 2011, and ordered further investigation.

Special Judicial Magistrate (CBI) Neel Kant Mani Tripathi passed the order on an application filed by Dr Sachan's wife Malti, who had challenged the CBI report which held that her husband's death was not murder but suicide caused by self-inflicted injuries and hanging.

The court held that the agency did not probe the facts and evidence collected in the judicial inquiry by Lucknow's chief judicial magistrate, which had declared Dr Sachan's death a murder and had ruled out the suicide theory.

The CBI had investigated Dr Sachan's death on the order of the Allahabad High Court. It filed the closure report on September 28 last year.

Dr Sachan was arrested in two cases of irregularities in the implementation of NRHM in Lucknow. While lodged in jail, he was named as an accused in the case of murders of CMOs Dr V K Arya and Dr B P Singh on June 17, 2011. After five days, he was found dead in an unused first-floor toilet of the jail.

While the government declared Dr Sachan had committed suicide, his family alleged that he had been killed to prevent him from making disclosures which could have implicated influential people. Following a PIL, the high court asked the CBI to investigate Dr Sachan's death.
