  • Some questions have no easy answers. What to do, for instance, when a high court judge accuses a Union minister of interference? Is it for the judiciary to investigate (for contempt of court) or the police? Then there is the moral dimension. After all, were the allegation to be substantiated, the minister’s continuation in the Cabinet would be difficult. To top it all, Justice R. Reghupathy, a judge in the Madras high court, having declared in open court that a minister tried to influence him, is yet to name names, and has recused himself from the case. There is now uncertainty on even basic facts. While initially it was reported that the minister allegedly spoke to the judge on telephone, Chief Justice of India K.G. Balakrishnan has told this newspaper that no such call was made; Justice Reghupathy’s allegation is that a lawyer claimed to him that a minister was interested in the case. The way forward is such a minefield, that it would be tempting for everyone to just not answer the question, and forget such an allegation was ever made.

    That would be a mistake. In the absence of transparency, gossip and innuendo reign. The name of a particular minister is doing the rounds; Former Tamil Nadu Chief Minister J. Jayalalithaa has pointed fingers at Union Communications Minister A. Raja. But that is unfair to him: Raja has not ever been publicly accused by the judge. If convinced of his own innocence, it is in Raja’s own interest to demand a public inquiry.

    The Judge erredBy: Dr Jayadev | 06-Jul-2009 Reply | Forward Respected high court judge ought not to have created a drama in court by saying that some minister tried to influence him. There being a lot of ministers, till the matter is settled any one could be suspected. The Judge is also reported to have said that he will report the matter to the PM if an apology is not tendered. Alas is it so simple a matter to be put under carpet by a simple apology from an advocate ?

Reghupathy. Becuase this is neither the first incident nor will it be the last incident. Politicians influencing and interfereing in every aspect of Judiciary and executive is an open secret. Judiciary is not a holy cow either. Whole system is rotten. It is like taking a glass of wter from the sea and saying the water is salty. I only pray Lord Krishna to have his promised recarnation to finish the guilty.

We all know how much corruption exists in the lower courts. Even at the highest levels such as high courts and supreme court, a lot of manupulative practices are evident. Government protects the mighty and rich and judiciary under the garb of non proactive and there fore neutral also protects the rich and powerful. The general public is helpless in this matter. It is the powerful lawyers turned politicians and are genuinly interested in making India a sane society can only help by their activism.
