  • Judicial transparency is no easy business. Take the declaration of judicial assets. Chief Justice Balakrishnan has no objection to Parliament passing such a law. But he points out that many judges were well-to-do lawyers before they joined the Bench. Scrutinising their assets slanders them without cause, making attracting fresh talent to the Bench difficult. Or take the demand for executive say in judicial appointments. The chief justice asks: which politician? After all, the role of a single party/leader is bound to be partisan. Equally, the way forward when a judge accuses a minister of interference requires sensitivity. But that doesn’t mean it must not be attempted. For in the mean time, names will be thrown around, entire institutions tainted, and faith in the system threatened. The details of who and how can come later, but

    the bottom line is this — Justice Reghupathy’s allegations must be inquired into, and that inquiry must be transparent.

    The Judge erredBy: Dr Jayadev | 06-Jul-2009 Reply | Forward Respected high court judge ought not to have created a drama in court by saying that some minister tried to influence him. There being a lot of ministers, till the matter is settled any one could be suspected. The Judge is also reported to have said that he will report the matter to the PM if an apology is not tendered. Alas is it so simple a matter to be put under carpet by a simple apology from an advocate ?

Reghupathy. Becuase this is neither the first incident nor will it be the last incident. Politicians influencing and interfereing in every aspect of Judiciary and executive is an open secret. Judiciary is not a holy cow either. Whole system is rotten. It is like taking a glass of wter from the sea and saying the water is salty. I only pray Lord Krishna to have his promised recarnation to finish the guilty.

We all know how much corruption exists in the lower courts. Even at the highest levels such as high courts and supreme court, a lot of manupulative practices are evident. Government protects the mighty and rich and judiciary under the garb of non proactive and there fore neutral also protects the rich and powerful. The general public is helpless in this matter. It is the powerful lawyers turned politicians and are genuinly interested in making India a sane society can only help by their activism.
