Dinakaran's name for elevation effectively put on hold

  • The elevation of Karnataka High Court Chief Justice P D Dinakaran, facing allegations of land- grabbing, to the Supreme Court has been effectively put on hold with the Centre being asked to process only the names of four other judges cleared for promotion along with him.

    "We have only asked that the names of four other judges (high court chief justices) should be processed for their appointment as judges of the Supreme Court," Chief Justice of India K G Balakrishnan told reporters on the sidelines of the All-India Conference of the Central Administrative Tribunal (CAT).

    Justice Balakrishnan however said no decision has been taken on dropping Justice Dinakaran for promotion observing that his name has only been ‘delinked’ from the other four judges at this stage for elevation.

    When asked about media reports that Dinakaran's name has been dropped, the CJI, who at first only replied, "No, no", later said, "We have not taken any decision as yet".

    Balakrishnan, who appeared reluctant to speak to the media, said the decision asking the government to process the names of other four judges means that Dinakaran's name has been ‘delinked’ at this stage for his appointment as a judge of the Supreme Court.

    The five-judge Collegium headed by CJI had earlier cleared along with that of Dinakaran the names of A K Patnaik, T S Thakur, S S Nijjar and K S Radhakrishnan, Chief Justices of the Madhya Pradesh High Court,Punjab and Haryana High Court Calcutta High Court and Gujarat High Court respectively.

    Justice DinakaranBy: S.N.Iyer | 02-Nov-2009 Reply | Forward It is mysterious as to why the CJI and the collegium are yet hesitating despite the report from the Collector and revenue officials. This issue will perhaps escalate to become a impeachment rather than mere removal of his name from the list for promotion to the Supreme Court. The principle that the incumbent should be above any suspicion should rule. This delay will give Justice Dinakaran more time to use other means to get out of trouble!!

The larger issue is that how could an individula whose image has been so badly dented by allegations, proven or otherwise, be allowed to continue to sit on judgement on various cases in the high court and decide the fate of those involved?

The CJI should be impeached for the blunder of nominating him to the Supreme court. The Law minister if he is very honest, should put in his paper too and leave. But, we can't expect such honest moves from either party named in this comment.

The next question is can such judges have any say in judicairyn in High Courts? Perhaps Moily knows he has several cabinet colleagues like A. Raja, who can openly threaten the judges for favourable judgements!!! Manmohan Singh remains an incompetent spectator and cannot function as PM though he keeps refusing he is nopt a weak prime minister!!! We have bunch of AH babus in Delhi!-Balu, Canada
