Don’t get emotional over juvenile justice: CJI

Chief Justice of India Altamas Kabir on Saturday said that there was no need to get "emotional" about the juvenile justice system in India and that it was not the domain of judiciary, but of Parliament, to discuss the curtailment of the age of juvenility.

Addressing the "role of courts in administration of criminal justice" at the East Zone Regional Judicial Conference here, the CJI said: "We cannot allow our emotions to get out of control howsoever heinous the crime may be (in matters of juvenile justice)."

The CJI also expressed concern over "trial" by media. "In case of media trial, justice is delivered even before investigation is over." Even in "open and shut" cases, one has the right to be heard, he added.

On protection of witnesses, the CJI said that the concept was "almost not available". He stressed that the number of sub-ordinate courts needed to be doubled. "The biggest challenge is length of time to dispose of a case. In the entire system, there is something that has gone wrong somewhere," the CJI said.
