Driver changing statement, say police

A day after two women were killed and four others were injured when they were knocked down by a speeding Tata Indica car, Aarey Colony police have booked the driver for culpable homicide not amounting to murder under Section 304 which attracts a higher punishment that Section 304 (A) (death due due to negligence) invoked earlier.

According to police officers, based on statements of the injured victims and other eyewitnesses, the police slapped Section 304 of the IPC on driver Pravin Kanojia, instead of Section 304 (A).

The 25-year-old driver, a resident of Dahisar was on Wednesday presented in a court which remanded him in police custody till January 27.

The victims, all residents of Aarey Milk Colony, were on their way to SEEPZ in Andheri east for their morning shift were crossing a street when the car hit them.

"We had booked Kanojia for death due to negligence. We later changed it to culpable homicide not amounting to murder," said Police Sub Inspector Tejashri Pachpute, the investigating officer of the case.

"We have also booked him under Section 279 (rash and negligent driving) which covers his negligence," said Pachpute.

Police custody of Kanojia was sought to record his statement as he has been changing his version, police officers said. "After the accident he told us he was alone in the car. Later he said there were two passengers who were employees Larsen & Toubro (L&T)," said Pachpute.

She added the police also wanted his custody to get details of the owner of the car as well as Kanojia's employer.
