Framing of charges against Shiney adjourned till Sep 25
A court adjourned the framing of charges against Shiney Ahuja, arrested for allegedly raping his maid.
A court adjourned the framing of charges against Bollywood actor Shiney Ahuja, arrested for allegedly raping his maid, till September 25 after the defence lawyer argued that the DNA report of the actor is negative and sought copies of the forensic reports of both the accused and victim.
Ahuja’s lawyer Shrikant Shivade sought for copies of the forensic reports of the actor and the victim,on which the prosecution is relying upon in the trial against the actor.
“While the victim’s DNA report is positive and some male DNA is found,Ahuja’s DNA report is negative. I would need to peruse the forensic lab reports to argue my case,” Shivade said.
“One of vaginal swabs of the victim is missing and the DNA report of the actor and victim can be tampered by the police,” Shivade alleged.
Ahuja,36,who is lodged at the Arthur Road prison in central Mumbai, was arrested on June 15 for allegedly raping his domestic maid at his residence in suburban Oshiwara.
The actor has approached the Bombay High Court seeking bail following the rejection of his bail plea by the sessions court on September 11 after it observed that there was prima facie case against him.
Additional sessions judge S R Trivedi will pass an order on the application on September 25.
Ahuja, clad in a grey shirt and blue jeans, was seen talking to his wife and parents during the court proceedings. Shivade told the court that before arguing on the charges to be framed against the actor,he would need to go through the forensic reports to build up his case.
He further sought for the court to summon the director of the Forensic lab directing him to bring the reports in a sealed cover.
