Govt appeals in HC against removal of Noida chairman, CEO

The state government on Wednesday filed a special appeal before the Allahabad High Court against the orders passed by the court on December 7, while hearing a contempt petition.

In its order, the court had directed the state government to remove Noida Chairman Rakesh Bahadur and Chief Executive Officer Sanjeev Saran by December 14 in compliance of the November 8 order.

State Advocate General S P Gupta said: "An appeal has been filed against the order on the contempt petition of the court."

He, however, said that he was not immediately aware of the grounds on which the appeal has been filed.

On December 7, a single judge bench of the High Court had directed the state government to remove the two officers from their current posting by December 14, failing which the chief secretary and principal secretary (Industrial Development) were to be present themselves before it.

Earlier, the government had filed a review petition on November 19 against the November 8 order. It was then contended by the government that any action regarding the compliance of the order should be taken after the review petition was disposed of. However, the court had not stayed the compliance of the November 8 order. M D Singh "Shekhar", counsel for the petitioner, Madhav Samaj Nirman Samiti, which had filed the PIL demanding the removal of the two officials from their posts, said: "We have received notices in connection with the appeal filed by the state. Also, we have received three notices in connection with separate appeals filed by three other officials against whom the court had passed the orders on December 7.''

On November 8, apart from ordering immediate removal of Bahadur and Saran from their current posts, the High Court had also directed the government not to give them the charge of any other development authority. It also prevented the government from posting them anywhere in western Uttar Pradesh.
