Maharashtra Government would urge the Bombay High Court to view CCTV footages of Ajmal Kasab and his slain accomplice Abu Ismael committing terror attacks in and around Chhatrapati Shivaji Railway Terminus on November 26,2008,which would prima facie prove their involvement in the crime.
The CCTV footages would provide ample evidence to show that Kasab and Ismael had committed terror acts at CST,said Government Counsel Ujjwal Nikam.
He said the films have evidential value and would prima facie prove Kasab’s involvement in the crime.
The films would be screened next week after obtaining the approval of the High Court,which is hearing confirmation of death sentence awarded to Kasab,Nikam said.
Earlier,one CCTV footage showing Kasab and Ismael moving around in CST with AK 56 rifles in their hands and firing at policemen was screened in the High Court but due to technical glitch it was stopped midway.
The Court then decided to view the films later.
Earlier,justifying death penalty imposed on Kasab,Nikam had tabled before the High Court few photographs of Kasab and Ismael in terror acts in CST and outside near Times of India building.
Nikam said he would also submit arguments on conspiracy hatched by LeT to create terror in Mumbai,the financial capital of India,by sending terrorists to kill people and take VIPs as hostages to demand separate state for Muslims in India and independence for Kashmir.
In order to establish the LeT’s conspiracy,Nikam said he would rely upon the confession made by Kasab which was accepted by the trial court as true and voluntary disclosure by him.
Kasab has,however,taken the stand that he had not participated in the terror attacks at CST and elsewhere and that he had been allegedly framed by police.
Kasab has also pleaded in the appeal filed by him to challenge the death sentence that the trial court had not accepted his confession in toto but only partially accepted it.
According to his lawyers Amin Solkar and Farhana Shah,a true and voluntary confession cannot be partially accepted by the court and that it has to be either accepted or rejected in toto.
On May 6,the trial court had sentenced Kasab to death for his role in killing 166 persons in the dastardly terror attacks in Mumbai.
The sentence has now come up for confirmation before the High Court which would also hear Kasab’s appeal against his conviction and appeal filed by the state challenging acquittal of Faheem Ansari and Sabauddin Ahmed on the ground of “doubtful evidence”.
