Gujarat Bar opposes Justice Pal’s transfer to state

The Gujarat High Court Bar Monday passed a resolution “strongly” opposing the transfer of Justice Mohinder Pal of Punjab and Haryana High Court to the state.

The resolution,backed by over 450 lawyers,said,“Gujarat High Court Advocates’ Association very strongly opposes transfer of Justice Mohinder Pal. (The) Association has always and invariably accepted every judge coming from other high courts with open arms…

“However,it appears that this virtue of (the) Association is taken as its weakness. Chief Justice of India is earnestly requested that Gujarat High Court may not be considered as a dumping ground. Transfer of any judge from any corner of the country is most welcome on any ground other than under compulsion where a needle of suspicion is pointed against that judge on the ground of integrity.”

The Bar requested the CJI and “his Companion Judges in the collegium to reconsider the decision… and till the issue is reconsidered,proposal… may be put on hold”.

Bar president Yatin Oza said the resolution would be sent to the CJI.

On December 6,The Indian Express had reported that Chief Justice Ranjan Gogoi of Punjab and Haryana High Court had apprised the CJI of “illegalities and irregularities” in an order delivered by Justice Pal.

Justice Gogoi told The Indian Express that the order was one of the “major reasons” behind Justice Pal’s transfer.
