Haryana to re-consider tax tribunal appointments

The Haryana government Monday informed Punjab and Haryana High Court that it will reconsider appointments of chairman and members of Haryana Tax Tribunal within one month. The state also assured the high court that appointments will be considered in accordance with directions issued by Supreme Court in Sampath Kumar's case of 1987 and fresh directions on October 16, 2012 in relation to the appoint of chairman of Gujarat Revenue Tribunal

The petition challenging appointment of K S Bhoria as chairman and those of Yudhavir Singh, Subhash Kaushik and Mukesh Lata Gupta as members of the tribunal came up for hearing before a Division Bench comprising Chief Justice Arjan Kumar Sikri and Justice Rakesh Kumar Jain.

The court was apprised that in May, 2011, Chief Minister Bhupinder Singh Hooda had inter-alia decided to appoint Justice S L Bhiana as chairman and Rajender Ballah as member of Haryana Tax Tribunal. However, later the CM changed his mind and on reconsideration, appointed Bhoria as Chairman and Mukesh Lata Gupta as member of the tribunal

The case will now come up for hearing on April 3.
