HC asks cops to return kids to uncle

The Calcutta High Court on Tuesday directed that the order of a Norway court which had ruled that the custody of two children, Abhigyan and Aishwarya, sent back from that country after a custody row, be given to their uncle, be upheld.

The direction came hours after the police handed over the two children to their mother Sagarika Chakrabarty in the morning.

Sagarika had earlier appealed to the court for the custody of the two children, who were staying with their uncle Arunabhas Bhattacharya at Kulti in Burdwan district following an order from the Norway court.

On Tuesday, when the High Court was told about the the fact that the police had handed over the two children to their mother, Justice Dipankar Dutta directed the police to return the child to their uncle. He also asked the state to file a compliance report on Wednesday and fixed the hearing for next Monday.

Abhigyan and Aishwarya were separated from their parents Sagarika and Anurup Bhattacharjee after the order of the Norwegian Child Welfare Services in May last year. In April last year, they were brought to India and handed over to Arunabash.

In May, Sagarika approached the Child Welfare Committee, Burdwan, which ordered that the children be handed over to her. When the order was not implemented, she moved the High Court.

The case was fixed for hearing on Tuesday but it was adjourned. But the police had by then already picked up the two children from Kulti and handed them over to Sagarika.
