HC Bench rejects AVBPs’ plea against DU decision

The Delhi HC Bench refused to interfere with the decision of Delhi University to debar three AVBP candidates from contesting elections.

The Delhi High Court Bench refused to interfere with the decision of Delhi University to debar three AVBP candidates from contesting coming students union election for violating the code of conduct by exceeding the fixed limit of expenditure and use of cars in campaigning.

A Division Bench of Chief Justice A P Shah and Justice Manmohan rejected the appeal filed by Rohit Chahal,Lalit Kumar and Ashok Khare,challenging the single judge’s order dismissing their petition against the University’s decision last week.

On August 28,the Election Officer had disqualified them as they had failed to comply with the James M Lyngdoh Committee recommendations.

They were found spending money in excess of the fixed amount of Rs 5,000,using cars and organizing rallies for the election campaign,which were against the recommendations of committee headed by former Chief Election Commissioner Lyngdoh whose report was approved by the apex court.

The disqualified AVBP candidates had alleged the University has misinterpreted the recommendations and wanted the court to restore their right to contest the election.

Besides AVBP candidates,two NSUI poll contestants were also disqualified by the University on similar ground. NSUI had contended that the party was against the Lyngdoh committee recommendations as they were not practical and the election officer cannot exercise his power once their names were finalized.
