HC cancels BHU ordinance on students’ council; polls on hold

The Allahabad High Court on Thursday struck down the ordinance passed by the Banaras Hindu University (BHU), which entailed nomination of faculty members as office-bearers of the elected students' council.

The court has directed the university to re-frame the relevant clauses. The elections to the BHU's students' council, which was to be held on September 23, will remain postponed till the new rules are framed. Hearing a petition filed by Vikas Singh, who was general secretary of the BHU students' union when the elections were last held in 2006, a single judge bench of Justice A P Sahi declared Clauses 4.1.1, 4.1.2 and 4.1.3 of the Ordinance ultra vires saying it did not conform to the Lyngdoh Committee recommendations that had been accepted by the apex court. The ordinance in question had been brought in earlier this year. "Our contention was that these provisions were in conflict with the Lyngdoh panel recommendations, which said apart from a student, no person, including faculty members, could be allowed to become office-bearers of such a body," said senior advocate UN Sharma, counsel for the petitioners.
