HC directs CBI to file affidavit on steps to extradite Davy

Danish court refused to allow extradition of Davy on ground that prisoners are tortured in India.

The Calcutta High Court on Wednesday directed the CBI to file an affidavit within three weeks stating the steps it has taken to extradite Purulia armsdrop case accused Kim Davy and two other Danish citizens.

Taking up a PIL,a division Bench comprising Justices P C Ghose and Soumen Sen,directed the CBI to file the affidavit on steps taken for extradition of Kim Davy,Peter Haestrup and Brian Thune to India to face prosecution in a Kolkata court.

A Danish court recently refused to allow the extradition of Davy to India on the ground that prisoners are subjected to torture in India.

The Bench,hearing another PIL by the same petitioner Deepak Pralhadka,directed the Ministry of Home Affairs to file an affidavit within three weeks as to what action it has taken in ratifying the UN Convention against Torture 1984.

The petitioner claimed that though the Union government has signed the Convention in 1997,it has failed to ratify the same.

He alleged that this was the reason why the government failed to secure extradition of Davy.
