HC goes to SC against own ‘blogger judge’ for ‘berating’ Dinakaran

The Karnataka High Court approached the SC against its own judge,Justice D V Shylendra Kumar.

In a rare move,the Karnataka High Court today approached the Supreme Court against its own judge,Justice D V Shylendra Kumar,accusing him of “berating” Chief Justice P D Dinakaran by using “intemperate” language in his blogs. The Supreme Court vacation bench posted

the petition for hearing tomorrow.

Alleging that he was defying his own Chief Justice,the High Court petition sought quashing of some orders passed by a bench headed by Justice Kumar.

Known as the “blogger judge”,Justice Kumar used his writings to openly criticise Justice Dinakaran who is facing an impeachment motion over allegations of corruption.

The HC petition,filed through the Registrar General,alleged that the bench headed by Justice Kumar even “orally threatened to initiate contempt proceedings” against the Registry if it did not comply with orders of the bench.

The Registrar General also pointed out that despite being aware that four orders of a bench headed by him — in which he questioned the administrative decisions of Justice Dinakaran relating to the roster of benches and work allocation for judges in principal and circuit benches — had been challenged in the Supreme Court,Justice Kumar had called for files from the Registrar of the High Court for a hearing today on the same matter.

In a recent post on his blog,Justice Kumar wrote how he had been “favoured” by being posted to both the circuit benches of the High Court on five occasions while many other judges had not been considered and “overlooked”.

He also wrote about how he and his wife had gone to meet Justice Dinakaran at his residence but after waiting for twenty minutes,they were told “the Dinakarans are not willing to see us”. He regretted how a gift of fruits they had carried with their “good wishes” was not accepted and returned.
