HC rejects plea challenging govt’s transfer policy

The Allahabad High Court has dismissed a PIL challenging the state government's transfer policy. The court said it was not inclined to interfere in a domain that was within the purview of the executive.

A division bench of Acting Chief Justice Shiva Kirti Singh and Justice Sanjay Misra on Thursday dismissed the petition filed in Ajay Kumar Mishra, an advocate.

Rejecting the petition, the court said: "Jurisdiction to transfer its employees is vested with the executive organ of the state and it is controlled by policy of the government, which again lies in the domain of the state government.monitoring thousands of transfers, even on the touchstone of the policy framed by the state government, does not deserve to be taken by this court in a public interest litigation.We are not persuaded to exercise writ jurisdiction in public interest for the purpose of interfering or monitoring huge number of transfers effected by the competent authorities."

The PIL had sought the intervention of the court on the ground that large scale transfers effected by the new government, ever since it came to power early this year, had affected the morale of the efficient and the competent among the officers. It had also alleged that the government was carrying out these transfers along community lines, thereby favouring officers from certain communities, while relegating the others to unimportant positions. It was also argued that many officers were being transferred more than twice within a month, which was putting a burden on the state exchequer.
