Centre has no power to ban smoking in pvt office, HC told

  • ITC Ltd, which has approached the Delhi High Court against the Centre's notification banning smoking in private offices, on Wednesday contended that the government has no power to take such a decision.

    Senior Advocate Soli Sorabjee, appearing for the company contended that the Act under which the notification was issued has already been stayed by the Madras High Court.

    "When the Act has already been stayed where is the question of framing rules under the law. The government need to have statutory power to frame rules. After the Madras High Court interim order staying the operation of the law, the government has no power under the law," he contended before a Bench headed by Justice Vikramjit Sen.

    He submitted that the rule which bans smoking at work places is unjustified as it would include private offices like a lawyer's chamber and studio of an artist.

    "Private office cannot be called a public place as these are not accessible to general public," he said while pleading that the government be directed not to take any coercive action against the company.

    The Centre, however, opposed the plea saying that its petition challenging the Madras High Court order is to be heard by the Supreme Court on September 29. It submitted that ITC's petition be heard after the date.

    The court then deferred the hearing of the case till September 30.

    Besides ITC, two others petitioners, including Indian Hotels Association, have also moved separate pleas challenging the May 2008 notification issued by the Union Health Ministry.

I cannot undertsand why hotels would want smoking allowed.Hotel rooms stink and are totally unhaelthy.Govt and court show courage and have this dismissed

Smoking in closed surroundings should never be allowed and government should be very strict in enforcing the ban and likewise selling cigarettes to minors must be made punishable (with fines and imprisonment also). ITC must be thanking it's stars that it is still able to sell cigarettes and make money. Because if people really cared for their health, no one will be smoking soon.
    The 'Basis'By: Suman | 24-Sep-2008 Reply | Forward Better than anybody else explaining the BASIS, the Supreme court will soon expain to you the BASIS. As long as the companies/offices have separate smoking areas or rooms which have effective systems to clear the air of the harmful gases (just like in western countries), the companies have all the right to allow smoking in those separate designated smoking areas. In homes in western countries, if non-smokers dont like it and often voluntarily on their own, smokers go out to the balcony or to the garden to smoke. Smoking is not allowed in public places like railway stations, bus stops, street etc because others do inhale a smoker's secondary smoke. Dictats like Anbumani's before being implemented require scientific study or we should copy effective systems from the developed countries because they have already studied it and implemented their scientifically effective systems. Anbumani is not a real doctor and he is not an angel, for people who know his background. His move is a political stunt to create an issue to raise his party's and his own image. We cant force our subjective views on everybody, it is smokers's/drinkers's right to smoke or drink as long as they dont affect the health of non-smokers including teetotalers like me.
