HC uphold notification banning use of plastic bags

Delhi High Court on Tuesday upheld a city government's notification banning use of plastic bags in specified areas of the capital.

The Delhi High Court on Tuesday upheld a city government’s notification banning use of plastic bags in specified areas of the capital.

A division bench headed by Justice Madan B Lokur dismissed the plea of plastic manufacturers’ association challenging the notification on the ground that they were not consulted before bringing it into the force.

All India Plastic Manufacturers’ Association had sought the court’s direction to quash the notification against the use of plastic bags in the capital.

On January 7,the Delhi government banned the use of plastic bags in shopping malls,five star hotels,restaurants,dairies,fruits and vegetable outlets under the Environment Protection Act.

The ban had followed the Delhi High Court’s August 7,2008 order based on the Justice Chopra committee report. The Court,however,made it clear that the government can allow plastic bags of 40 micron limit.
