In 2004, passport case against Pathan, ‘aides’ had been quashed

  • The entire case was created on the basis of the confession of Samirkhan, who was dead, and it seemed nothing but police “fancy”, the court added.

    Finding no prima facie case against any of the accused for any offence, the court had discharged all 12.

    This order was delivered by then Additional Sessions Judge B N Jani in January 2004. The same was confirmed by the High Court and the Supreme Court subsequently.
